Penalties for Shoflifting in Rhode Island

Shoplifting First Offense- is a misdemeanor, subject to a fine of not less than $50.00 or two times the full retail value of the merchandise, whichever is greater, but the fine cannot exceed $500, up to one year in at ACI

Shoplifting Prior Convictions Value $100 or less-is a misdemeanor, subject to a fine of not less than $50.00 or two times the full retail value of the merchandise, whichever is greater, but fine cannot exceed $500, up to one year in at ACI

Shoplifting Prior Convictions Offense Value Over $100-is a felony, subject to a fine of not more than five thousand dollars ($5,000), up to 5 years at ACI, or both.


It is important to note, that a prior shoplifting charge that is not a conviction would not make a second offense a felony. A defendan who had plead to a prior charge and received a filling or straight probation without a fine, would not be subject to the enhancement to a felony.
